Important information
Welcome to NorthWest EagleEye Enterprises' Terms of Service. By accessing or using our drone pilot and aerial photography/videography services, you agree to be bound by the terms and conditions outlined below. These terms are designed to ensure clarity, protect both parties, and facilitate a smooth and professional service experience. We pride ourselves on our adaptability and commitment to excellence in every aspect of our service. Please review them carefully.
Common questions about our terms of service
To ensure transparency and address potential queries, we've compiled answers to common questions regarding our service agreements. Our approach is rooted in quality and integrity, ensuring that everything we do reflects our commitment to excellence.
Core service agreement principles
Before commencing any drone pilot or aerial photography/videography service, clients must agree to several key understandings. These include ensuring the proposed flight area is legally permissible for drone operations, providing accurate site information, and adhering to all safety guidelines communicated by our pilot. Clients are also responsible for securing any necessary private property access or specific permissions for the shoot location. Furthermore, all projects require a signed service agreement outlining the scope, deliverables, and financial terms.
Payment and cancellation policy
A non-refundable deposit fee is required to secure your booking and schedule our drone pilot services. This deposit covers initial planning and resource allocation. Should you need to cancel or change your appointment, please contact us as soon as possible at [[phonenumber]] or [[email]]. While the deposit remains non-refundable, we will work with you to reschedule where feasible, subject to our pilot's availability and at our discretion. Further details regarding payment schedules, final balances, and specific cancellation windows will be outlined in your service agreement.
Content ownership and usage rights
NorthWest EagleEye Enterprises retains full ownership and all intellectual property rights to all aerial photos and videos captured by our drone pilots. We provide and sell to you a license for the use of this content for the specific purposes outlined in your service agreement. This license typically grants you non-exclusive rights for marketing, promotional, or personal use as agreed upon. Any additional or broader usage, such as resale or sub-licensing, must be explicitly negotiated and agreed upon in writing. We reserve the right to use the content for our own portfolio and promotional materials, unless otherwise stipulated.
Service limitations and environmental factors
Our drone operations are subject to various factors including weather conditions (wind, rain, fog), airspace restrictions, and regulatory compliance. We prioritize safety and legal adherence above all else. In the event of unsuitable conditions or unforeseen restrictions, NorthWest EagleEye Enterprises reserves the right to postpone or cancel a flight. We will communicate any such issues promptly and work with clients to find alternative solutions. Certain locations or conditions may also limit the type of footage that can be safely and legally acquired.
Limitation of liability
NorthWest EagleEye Enterprises strives for excellence and operates with professional care. However, our liability for any damages arising from our services is limited to the fees paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages. Clients agree to indemnify and hold harmless NorthWest EagleEye Enterprises from any claims, damages, or expenses arising from their use of our services or content, beyond the scope of our agreed responsibilities.
Feedback and dispute resolution
We value your feedback and are committed to resolving any concerns promptly and fairly. If you have any questions, feedback, or disputes regarding our services or these terms, please contact us directly at [[email]] or [[phonenumber]]. We encourage open communication to find a mutually agreeable solution. For formal disputes, parties agree to first attempt resolution through good faith negotiations before pursuing other legal avenues, as outlined in the full service agreement.
